Terms of Service

1. Service Overview

OnboardGuest (hereinafter "the Platform") is an online service published by OnboardGuest, headquartered at 75 rue Leon Blum, France. Contact: contact@onboard-guest.com.

The Platform enables hospitality professionals and short-term rental hosts (hereinafter "the User" or "the Host") to create and manage digital welcome portals for their guests.

2. Acceptance of Terms

Accessing and using the Platform implies full and unreserved acceptance of these Terms of Service. If you do not accept these terms, you must immediately stop using the service.

These Terms apply to any User who registers on the Platform, whether on a free or paid subscription plan.

3. Account Creation and Access

To access the Platform, the User must create an account by providing accurate and up-to-date information. The User is responsible for keeping their login credentials confidential and for all activity carried out from their account.

OnboardGuest reserves the right to suspend or delete any account in the event of a violation of these Terms, or abusive or fraudulent use of the service.

4. Service Description

The Platform offers the following features depending on the subscribed plan:

  • Creation and customization of a digital welcome portal (WiFi, services, local guide, amenities, house rules, etc.)
  • QR code generation for guest access to the portal
  • Multilingual support (up to 10 languages)
  • Visual customization (branding)
  • Visit statistics (Pro plan)
  • Multiple property management (Pro plan)

OnboardGuest reserves the right to evolve the service features at any time without prior notice.

5. Subscriptions and Billing

The Platform offers a free plan with limited features, as well as a paid Pro plan giving access to all features.

Payment: Paid subscriptions are billed monthly via Stripe, a secure payment provider. By subscribing to a Pro plan, the User authorizes OnboardGuest to automatically charge their payment method at each renewal date.

Renewal: Subscriptions automatically renew at each billing date unless cancelled by the User from their subscriber portal beforehand.

Price changes: OnboardGuest reserves the right to modify its pricing. Any change will be communicated to the User at least 30 days before taking effect. Continuing to use the service after that date constitutes acceptance of the new pricing.

Refunds: Digital service subscriptions that have been fully performed are non-refundable. No refund will be issued for partially consumed billing periods in the event of mid-cycle cancellation.

6. Termination

The User may cancel their subscription at any time from their subscriber portal. Cancellation takes effect at the end of the current billing period. Access to Pro features is maintained until that date.

Upon cancellation, data and portals created by the User will be retained for 30 days, then permanently deleted, unless legally required to retain them.

7. Personal Data

OnboardGuest collects and processes the following personal data relating to the Host:

  • Account data: email address, login credentials
  • Property data: name, address, amenities, services, and any information entered through the platform's configuration forms and steps
  • Billing data: managed directly by Stripe (not stored by OnboardGuest)

This data is processed for the purpose of providing the service, managing user accounts, and improving the Platform. It is not sold to third parties.

In accordance with the General Data Protection Regulation (GDPR), the User has the right to access, rectify, delete, and port their data, as well as the right to object to its processing. To exercise these rights, contact us at contact@onboard-guest.com.

Note: OnboardGuest does not collect personal data of the end guests of hotels or rentals. The Host is solely responsible for the processing of their own guests' data.

8. Intellectual Property

All elements of the Platform (design, code, content, logos, features) are the exclusive property of OnboardGuest and are protected by intellectual property law.

Content entered by the User on the Platform (property information, photos, descriptions) remains their property. By publishing it on the Platform, the User grants OnboardGuest a non-exclusive licence to use it solely for the purpose of providing the service.

9. Liability

OnboardGuest endeavours to ensure the availability and continuity of the service. However, OnboardGuest shall not be held liable in the event of:

  • Temporary service interruption for maintenance
  • Data loss due to an event beyond its control (force majeure)
  • Inaccurate, incomplete or misleading content entered by the User in their portal
  • Non-compliant use of the service by the User

The User is solely responsible for the content published in their portal and agrees to comply with applicable regulations (accuracy of information, third-party rights, etc.).

10. Amendments to the Terms

OnboardGuest reserves the right to modify these Terms at any time. Changes will be communicated to Users by email or via a notice displayed on the Platform at least 15 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.

11. Governing Law and Disputes

These Terms are governed by French law. In the event of a dispute, an amicable resolution will be sought as a priority. Failing that, the courts with jurisdiction over the registered office of OnboardGuest shall have sole jurisdiction.

In accordance with applicable consumer protection regulations, any consumer has the right to use a certified consumer mediator free of charge for the amicable resolution of a dispute.
